Renting a House that is for sale?
Hi there we have lived in our apartment since September 1st, it was for sale then and then came off the market for most of the winter. It was recently put back on the market. I have showings coming through my house every other day, not only that but the landlord also sends me emails the same day requesting to see the property. Now I get this email,
“We would like to have an open house this Saturday between 1 and 3pm. Our realtor has suggested it would work best if you vacated the premises during that time. I hope this doesn’t cause too much of an inconvenience.
Also, we would like to ask that you refrain from making negative comments about the home to potential buyers or realtors in the future. If there is a problem that you would like us to address please let us know and we will do our best to take care of it. Again, we appreciate your cooperation.
Any advice? Vacate my own house? My personal belongings? That just doesn’t sound right to me. What are my rights NYState?
Not vacate my personal belongings as one woman said in the answers concerned about my belongings, Jewelry etc being stolen. That is what I Meant. Sorry for the confusion.
We have had constant problems with the showings and I saved the emails….landlord states showing at 12pm, I keep the house neat and tidy and no one shows then I proceed to let my two girls start playing again with toys etc and they show up at 2pm. Broker says must be some miscommunication between the landlords who are husband and wife. 2 other times I pack my girls up and leave for showings just to be nice and let them be private I pass by my house and no one comes. 2 times that happened! I left and no one came. I pay 1100.00 a month. It’s been extremely trying and yes we do have a lease that we can’t move until 1 yr has passed. Yes we have thought of buying it but the whole house shakes when truck passes! They are asking way too much as well.

An open house is a way for the agent to get leads on all sorts of buyers, not just your house.
You decide if it is convenient for you, but the agent will always need to be able to show the house on reasonable notice.
They do not mean vacate your personnal belongings or move out. No house would ever be sold if they had to do that. But you need to keep the house “showable” during this period.
Definitely lock up any jewelry or other valuables. That is just common sense and due diligence.
One nice thing about an open house, you get it ready on Friday, put your jewelry and valuables in your safe deposit box, then spend the weekend in Vegas or something.
I guess I missed the part about you renting before. You still have to be reasonable to the landlord, they are trying to sell.
First of all, I don’t think they are asking for your personal belongings not to be there, just not you. From the second paragraph they obviously think that you have said something negative to someone looking at the property in the past, that’s why they don’t want you there. Lastly, unfortunately they have the right to come into their property and show it at anytime as long as they give you an ample amount of notice. A few days is considered enough time. I honestly don’t think the e-mail sounds that bad.
Don’t know about your rights, but it’s definately a courtesy to the lanlord to vacate the premisis while it’s being shown.
Why not just buy it? If not, consider moving moving to another location. The showings won’t stop until the house is sold, and who knows how long that will take.
But, I would just move. You already know that the plae is being sold and you’ll need to move anyway. So I’d get a jumptart on that process.

Your landlord has the right to inspect the house upon reasonable notice to you, and probably to show it, again upon reasonable notice to you. READ your lease carefully and see what it says and doesn’t say about these issues. While they have the right to inspect and show your home, they DO NOT have the right to ask you to vacate (leave) the premises during an Open House or showings. It’s your place, your belongings, and your convenience. It’s you leaving, not your possessions. Again look at your lease language–an Open Housecould be deemed over and above reasonable.
You need a frank talk with your landlord, explaining how inconvenient and disruptive this has been. Count the # of showings. A considerate landlord who wanted you to leave for 3 hours should give you a gift certificate to a restaurant or ballgame or something in compensation for the inconvenience.
You have to be reasonable, as does he. If it is not convenient then tell him so. Insist on 24 hour notice. Without it you will NOT allow admitance.
I don’t consider endless lookie-loo walk-throughs to be reasonable. Those “negative comments” are your trump card.
I would tell him that “negative comments” come with non-stop strangers coming through your place. If he wants you out tell him that you will hold him accountable for all damages.
Tell him if he wants you and your family out that the cost of a movie and lunch at McD for your family is your price. If you are single, make that lunch at Red Lobster.
However, since you are in an apartment the standard around here is to do walk-throughs on ONE apartment, with an inspection of all of them only when there is a written proposal on the table.
I think the other answers are somewhat off the mark. “Just buy it?” Gee, I bet you didn’t think of that. “Just move out” Um, because you have a lease? “You will have to move out anyway” Not if you have a lease term that extends beyond the sale date.
Your rights to some degree depend on what your lease says. He can ask for access to your house, but he cannot make you leave. At this point I would negotiate with the landlord for some rent reduction in return for your inconvenience.
